Keekup Terms of Use

1. Acceptance of Terms

By accessing or using Keekup, you confirm that you have read, understood, and agreed to be bound by these terms. We may update these terms from time to time, and your continued use of the Services indicates your acceptance of the revised terms.

2. User Accounts

• Users must be at least 13 years old to create an account.
• Users may register using an email and password or third-party authentication (Google or Apple).
• You are responsible for maintaining the confidentiality of your account credentials and agree not to share them with others.
• If you suspect unauthorized use of your account, you must notify us immediately.

3. Acceptable Use

You agree to use Keekup only for lawful purposes. You may not:

• Violate any applicable laws or regulations.
• Use the service to distribute spam, malware, or harmful content.
• Engage in fraudulent activities, such as fake accounts or reviews.
• Attempt to gain unauthorized access to our systems or data.
• Upload content that infringes on third-party rights or intellectual property.
• Post content that is offensive, hateful, harassing, threatening or defamatory.
• Harass, impersonate another person, or violate another user's privacy.

4. Third-Party Services

Keekup integrates third-party services including:

• Google and Apple authentication for sign-in.
• Firebase (Google) for hosting, database and notifications.
• Google AdMob for advertising services.
• TMDB API for film and TV data, including streaming availability provided by JustWatch.
• TheTVDB for series and episode structure.
• IGDB (Twitch) for video-game data.
• Google Cloud Translation for on-demand translation of user-generated content.

5. Content Ownership & Copyright Policy

All content provided by Keekup, including text, images, and recommendations, is owned by Keekup or licensed from third parties. Users may not reproduce, modify, or distribute Keekup's content without permission.

6. User-Generated Content

Keekup lets you post reviews, ratings, comments, community messages (The Lounge, announcements), collections and rankings. By submitting content you grant Keekup a non-exclusive, worldwide, royalty-free licence to use, modify and distribute it within the service. Keekup has zero tolerance for objectionable content or abusive users.

• You may not post content that is offensive, hateful, harassing, threatening, defamatory, sexually explicit, or that promotes violence or discrimination.
• Every review, comment, community message and profile can be reported from within the app.
• Reported content is reviewed and, where it violates these terms, removed within 24 hours.
• Accounts responsible for such content are suspended or permanently terminated.
• You can block any user at any time; a blocked user can no longer contact you, and your blocked list is manageable from your profile.

7. Termination of Accounts

Keekup reserves the right to suspend or terminate any user account that violates these Terms of Use or engages in unlawful activities.

8. Payment, Refunds & Subscriptions

• Some Keekup features may require a purchase or a subscription.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
• Payment is charged to the user’s Apple account at confirmation of purchase.
• Subscriptions can be managed and canceled from the user’s Apple account settings after purchase.
• Cancellation takes effect at the end of the current period; no refunds are provided for any unused portion of the current period.
• Any unused portion of a free trial, if offered, will be forfeited when the user purchases a subscription.

9. Limitation of Liability

Keekup is provided 'as is' without any warranties. We are not liable for any indirect, incidental, or consequential damages.

10. Data Privacy & GDPR/CCPA Compliance

• Your privacy is important to us. Please refer to our Privacy Policy for full details.
• You have the right to access, modify, or delete your personal data.
• You may request data deletion by contacting contact@keekup.com.
• We do not sell your data to third parties.
• Users under 16 (EU) or 13 (US - COPPA) must have parental consent to use Keekup.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of France. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the French courts, without prejudice to any mandatory rights available to you under applicable law in your country of residence.

12. Dispute Resolution & Arbitration

• To avoid costly lawsuits, all disputes arising from these Terms will be resolved through binding arbitration.
• Users waive their right to file a lawsuit in court.
• Arbitration shall be conducted by a neutral arbitrator under the rules of [Arbitration Body].
• If arbitration is not enforceable in your jurisdiction, disputes shall be settled in [Your Local Court].

13. Changes to the Terms

We may update these Terms of Use periodically. Continued use of the Services after updates constitutes acceptance of the revised terms.
