Keekup Cards rules and special terms

1. Purpose and acceptance

These special terms govern access to and use of Keekup Cards, in the Keekup app (iOS and Android) and on the website cards.keekup.com. They complement the Keekup Terms of Use, of which they are an annex, and prevail over them for everything concerning Keekup Cards. Accessing Keekup Cards constitutes acceptance of these terms. If you do not accept them, do not use Keekup Cards.

2. One account per person

• Keekup Cards is available with a Keekup account, under the age conditions set by the Keekup Terms of Use (13 years old at least, parental consent as required by applicable law). Purchases are reserved for adults or minors authorised by their legal representative.
• Each natural person may hold and use only one account for Keekup Cards. The following are forbidden in particular: creating additional accounts ("alias accounts"), using a third party's account or lending your account, whatever the e-mail address or identity provider used.
• Keekup considers as controlled by the same person accounts that share, among other things, the same device or the same installation of the app, the same payment method, or whose play behaviour is coordinated.
• The account holder is responsible for everything done with it, including by a third party to whom they gave access.

3. Cards, KeeCoins and virtual items

• Cards, KeeCoins, boosters, items (frames, badges, artworks), experience points and Pass levels are virtual content. Keekup grants you a personal, non-exclusive, non-transferable and revocable licence to use them, limited to the Keekup Cards service. You do not own them.
• This content has no monetary value. It may not be sold, bought, rented or transferred for money, goods or services, nor transferred outside the service. Any such offer, inside or outside Keekup, is forbidden and leads to the removal of the content concerned.
• Free KeeCoins (rewards, missions, ads, events) and purchased KeeCoins are credited to a single balance and are not distinguished when spent.
• Card visuals (posters, photographs, works) belong to their rights holders and are used under the licences Keekup holds. They may not be extracted, reproduced or reused outside the service.
• Keekup may at any time change the catalogue, rarities, rates, KeeCoin prices, rewards, limits and rules of the game economy, correct an imbalance, and remove content obtained irregularly, without this giving rise to compensation.

4. Rewards, welcome kit and limits

• The welcome kit is granted once per person. It is not granted to a second identity created on a device or installation that has already received it.
• Daily, mission, achievement, universe, Pass and rewarded-ad rewards are subject to limits (daily quotas, caps, frequency) displayed in the app. These limits are part of the rules of the game; circumventing them by any means is forbidden.
• A rewarded ad only grants a reward if its viewing is confirmed by the ad network to our servers. Simulated, automated or diverted viewing is forbidden.
• Event and season rewards must be claimed before the end date shown in the app; after that date, they are lost.

5. Trades between members

• A trade is a proposal made by one member to another, freely accepted by the latter. Once accepted, a trade is final: the Cards change collection immediately and are not returned.
• You may only trade copies you actually hold as duplicates and that are not committed elsewhere (listing, offer, another trade).
• To protect the game, access to trades requires a minimum seniority in Keekup Cards and a minimum number of boosters opened, and clearly unbalanced proposals (one side worth much less than the other, according to the published rarity points) may be refused automatically. These thresholds are shown in the app when a refusal occurs.
• The following are forbidden: trades between accounts controlled by the same person, trades arranged against something outside the game (money, goods, services, gifts in another game), repeated one-way transfers intended to concentrate Cards on one account, and any agreement intended to distort the leaderboard or the economy.
• Keekup may undo the effects of an irregular trade: removal of the Cards and KeeCoins obtained, from each account concerned, without restitution to the other party.

6. Marketplace, price offers and Buyback

• On the Marketplace, members sell and buy Cards exclusively in KeeCoins, at a price within the bounds published for each rarity. Price offers hold the offeror's KeeCoins until their outcome.
• A concluded sale is final. Keekup may take a commission in KeeCoins, displayed before listing.
• The Buyback takes your duplicates in exchange for KeeCoins, at the price displayed at the time and within the published caps.
• Access to buying on the Marketplace, to price offers and to the Buyback requires a minimum seniority in Keekup Cards.
• Sales and purchases between accounts controlled by the same person, or intended to transfer value from one account to another, are forbidden.

7. Duels and games

• Keekup Cards games ("Higher or lower", "Masked card", "In order", "The casting", "Duel") earn KeeCoins within the published quotas. No winnings are guaranteed.
• In a duel, each player's stake is committed at launch and the pot goes to the winner; a stake is returned in case of a draw, a refusal, a cancellation before an opponent joined, or expiry. A round left is counted as lost.
• When no member is available, an automatic opponent ("Mia") may play, within the displayed limits. In case of defeat against Mia, the stake is lost.
• Colluding with an opponent to transfer stakes, playing against yourself with several accounts or automating answers is forbidden.

8. Leaderboard, seasons and Pass

• The leaderboard is computed from the Cards held, according to the published rarity points. Keekup may exclude from the leaderboard any account whose collection was built in breach of these rules, and recompute scores when the economy is corrected.
• A season has a start date and an end date displayed in the app. Pass levels and their rewards must be claimed before the claim end date; after that date, they are lost.
• The Premium Pass is digital content delivered immediately, valid for the current season only. It unlocks the Premium reward track of the levels already reached and to be reached; it gives no right over the following seasons.

9. Prohibited behaviour

In addition to the prohibitions of the Keekup Terms of Use, in Keekup Cards it is forbidden to:

• create, hold or use several accounts, or use a third party's account;
• obtain rewards, Cards or KeeCoins through additional accounts, reinstalls or any manoeuvre intended to circumvent the game's limits;
• sell, buy or exchange accounts, Cards, KeeCoins or items for real money or any consideration outside the game;
• collude with other members to distort trades, the Marketplace, duels or the leaderboard;
• use bots, scripts, modified emulators, altered clients or versions of the app, or intercept and modify communications with our servers;
• exploit a malfunction or a flaw rather than reporting it;
• simulate or automate the viewing of rewarded ads;
• abusively dispute purchases with the app stores or the bank after consuming their content.

10. Detection and data processed

• To enforce these rules, Keekup processes, in addition to the data described in its Privacy Policy: a random identifier specific to each installation of the app or browser, the device model and system, the history of trades, purchases, sales, duels and rewards, and the associated technical logs.
• This processing is based on Keekup's legitimate interest in preventing fraud and guaranteeing the fairness of the game. Data is kept for as long as necessary for this purpose, then at most three years after the account is closed when a sanction was issued, as evidence.
• Automatic checks may refuse an action (trade, purchase, welcome kit) in real time. A sanction within the meaning of Article 11 is always decided by a person on the Keekup team, after review.
• You have the rights provided by applicable regulations (access, rectification, objection, erasure) under the terms of the Privacy Policy.

11. Sanctions

• In case of breach of these rules, Keekup may take, depending on severity, repetition and intent, one or more of the following measures: a warning; refusal or cancellation of an action; temporary or lasting freeze of trades, the Marketplace, the Buyback and duels; removal of Cards, KeeCoins, items and progress obtained irregularly, including when they passed through other accounts; exclusion from the leaderboard; temporary or permanent suspension of access to Keekup Cards; suspension or closure of the Keekup account in accordance with the Keekup Terms of Use.
• Measures apply to all accounts controlled by the same person.
• Removed content is destroyed; it is neither returned to the members with whom it was traded nor compensated. KeeCoins purchased and spent as part of a fraud are not refunded.
• The sanction is notified in the app or by e-mail to the account address. Except in urgent cases, its general ground is stated.

12. Appeal

• Any measure may be appealed within 30 days of its notification, from the app (Settings › Write to us) or by e-mail to support@keekup.com, stating the account's username and any useful elements.
• Keekup reviews the appeal against the game log and answers within a reasonable time. If the measure is lifted, removed content is restored where possible; otherwise an equivalent compensation in KeeCoins is credited.
• The remedies provided by the Keekup Terms of Use (consumer mediation, competent courts) remain available.

13. Changes

• Keekup may change these rules. The version in force, with its effective date, is published at keekup.com/cards-rules. Substantial changes are announced in the app. Using Keekup Cards after the effective date constitutes acceptance.
• The parameters of the game economy (catalogue, rates, prices, limits, thresholds of the checks) are a matter of service operation and may change at any time without notice.
• Keekup may end Keekup Cards or part of its features, in principle with thirty days' notice announced in the app, without compensation for virtual content, purchased and unspent KeeCoins being handled in accordance with applicable law.
